BESPOKE WEDDING PHOTOGRAPHY CONTRACT

Wedding Date: 15/10/2018 @ 3pm

To cover guest arrival at The Grange in Lewes, The marriage service and group/informal photographs in the grounds of the Grange only following the Service.

Images to be supplied in full resolution digital download format only.




CONFIRMATION:
A signed ‘Contract for Wedding Photography Services’ and the payment of a £100 non-refundable booking fee retainer is required in order to confirm the photographic services of ‘NLC Photography’ on your wedding date. The final balance is then due 7 days prior to your agreed Wedding date. Failure to arrange the final outstanding payment will result in the cancellation of the booking and wedding photography on the day of the wedding. Your wedding date is not secured without the signing/completion of this contract.

THIRD PARTY INVOLVEMENT: At all times this service agreement is specifically between the bride, groom and Primary Photographer Nigel Coomber. No decisions by any third party shall be considered applicable and all final decisions shall lie with the Primary Photographer Nigel Coomber. Any monies paid against this Service Agreement by any third party shall be taken to be paid on behalf of the bride and groom and all decisions and discussions regarding this Service Agreement shall be between the bride, groom and Primary Photographer Nigel Coomber.
No discussion shall be entered into with any third party on any basis.

LATE PAYMENT FEES: There is a late payment fee for any payments that are not postmarked or delivered to NLC Photography by the required or agreed date. This will be based on a proportionate figure of the outstanding balance with a minimum of £30.00 or a percentage of 40% whichever is the greater. The wedding photography will not take place if full cleared funds are not completed within the timescale laid out in this contract. If you have any problems please speak with NLC Photography direct in order to resolve issues and avoid disappointment.

PRE-PLANNING CONSULTATION:
The parties agree to at least one but not limited to one, pre-event consultation approximately four weeks prior to the wedding in order to finalise shooting times and the clients request for specific photographs. In fact, an initial meeting is highly recommended prior to the signing of this contract.

COMPLETION SCHEDULE:
NLC Photography aims to provide you with your wedding images in digital format within 14 days Via our website and photo book if applicable to your chosen package will be supplied within approximately Six to Ten weeks of your wedding date. During busy periods, please note that this may be increased. However, you will be notified and kept informed during this process.
NLC Photography will never supply any RAW image files to its clients and will retain the rights to the artistic interpretation of all images at all times. Throwaways will never be provided as these are automatically deleted during the editing of event images at the sole discretion of NLC Photography. Throwaways are solely at the discretion of NLC Photography.

ALBUM DESIGN:
If a wedding album is included in your chosen package this will be designed once you have selected your preferred images or have passed over the right to the photographer to select the images. The Bride and Groom will be required to approve a draft of the design and only once this has been agreed will the album be sent to print. Printing can take up to four weeks once the layout is approved, but as this is outsourced, the photographer cannot be held responsible for any delay. Please be advised that once the album is approved it can not under any circumstances be changed.

Please be advised that images included within your particular chosen package relating to photo books and prints must be chosen within 6 months post wedding date. It is in the interests of all parties that this is undertaken. Failure to fulfil this agreement may result in additional charges, clearly, our aim and wish is to avoid this occurrence.

CO-OPERATION:
The client will be responsible for or have someone designated to, identify people of whom specific photographs are desired. NLC PHOTOGRAPHY advises that a pre-wedding shot list is provided by the wedding couple via email at least 7 days before the wedding date.

THE SCHEDULE:
The photography schedule and selected methodology are designed to accomplish the goals and wishes of THE CLIENT in a manner enjoyed by all parties involved. THE CLIENT and NLC Photography agree that positive cooperation and punctuality are therefore essential. Shooting commences at the scheduled time. Should the ceremony start late due to any reason whatsoever, NLC Photography will not be held liable for any photographs not taken and there is no guarantee that extra time will be permitted by NLC Photography or its assigned Photographers unless agreed by both parties. Reasonable “give and take” additional time will be provided for.


PERFORMANCE:
NLC Photograph shall not be liable for any failure to perform its obligations under this contract where such failure is a direct or indirect result of any acts of God, flood, fire, warfare, government laws of regulations, electrical failure, strikes by suppliers and/or any other condition beyond its control.

SEVERABILITY:
If any provision of this agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and the other provisions of the agreement shall remain in full force and effect.

ARTISTIC LICENSE:
NLC Photography shall be granted the artistic license regarding posing, lighting and locations used. Photographing and editing shall be deemed correct. All decisions made are in the best interest of the client who will be given the highest quality selection from the images taken, as mentioned, the RAW files will under no circumstances be provided to the client.

PAPARAZZI WEDDING GUESTS:
NLC Photography is to be the sole and exclusive professional photographer. It is understood that wedding guests will, of course, want to take photos of the Bride and Groom, however, the photographer must be given precedence over your guests in order to take the wedding photographs required. NLC Photography cannot be held responsible for lack of wedding photos if guests taking their own photos of the Bride and Groom have interrupted the photographer’s work or the B & G, Venue fails to allow sufficient time to undertake the B & G's photographic requirements. It is therefore important that you impress your timings with your venue to avoid disappointment.

HOUSE RULES:
Please note that photographers are sometimes limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. For example, some ministers insist that no flash photography is allowed and others insist that photographers can only shoot from a specific location. In such circumstances, the B & G agree to accept the technical limitations that may be imposed on the all be it high-quality professional equipment used. It is advised that the Bride and Groom make themselves aware of the rules of the venue and if necessary negotiate with the persons concerned if required.

DIGITAL NEGATIVES, PRINTS and COPYRIGHTS:
The photographs, digital negatives or prints produced by NLC Photography are protected by Copyright Law (all rights reserved) and may not be reproduced/re-edited or manipulated in any manner without NLC Photography’s explicit written permission. Upon final payment by THE CLIENT, limited or agreed copyright ownership of the resulting images will be transferred to THE CLIENT under the following conditions:

The digital negatives and/or prints are the property of THE CLIENT for personal use and for the purposes of their own reproduction. Addition prints maybe purchased by guest via our website for upto 12 months post wedding.

The client must obtain written permission from, and compensate NLC Photography prior to an event where THE CLIENT, THE CLIENT’S friends or relatives publish or sell the photographs for profit.

MODEL RELEASE:
The client hereby assigns and grants NLC Photography and its legal representatives the irrevocable and unrestricted right to use and publish photographs of the client or in which the client may be included both during an “engagement shoot” and the actual “wedding”, for editorial, trade, advertising or any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The client hereby releases NLC Photography and its legal representatives and assigns from all claims and liability relating to said photographs. It is agreed that NLC Photography may display and use the photographs taken for advertising, display, website and internet promotion, photographic contests, public display such as in Shopping Centres, Photography Books, Photography Instructional Books, Trade Displays, Studio Display, Television Advertising, Magazine Advertising, Social Media business page and any other purpose thought proper by NLC Photography. The client also agrees that after the wedding date images may be used as a “sneak preview” for marketing purposes on social networking sites such as and not limited to Facebook and Twitter.

EXCLUSIVITY / GUEST PHOTOGRAPHY:
It is understood that NLC Photography and any assigned Photographer will act as the sole and exclusive wedding photographer. Because of the fact that flashes from guest’s cameras may ruin shots taken by NLC Photography and any Photographer assigned to this contract, THE CLIENT acknowledges that they are responsible for notifying all of their guests that guest photography is not permitted at any time while the professional photographer/s are in session. NLC Photography suggests that a separate notice is placed on the invitations. The formal photography time is for the exclusive use of NLC Photography to capture the formal wedding portraits. Because of time constraints and the need for subjects to pay full attention to the professional photographer, guest photography cannot be permitted. NLC Photography will allow guests to take snapshots during the processional and recessional, during candid events at the Pre Ceremony Shoot, Wedding Ceremony, Post Wedding Shoot, any other Photography Session and at the altar during the time NLC Photography’s equipment is being packed up. In return for this consideration, NLC Photography insists no other guest photography take place when or where NLC Photography is working. No other guest/photographer using professional equipment will be allowed by NLC Photography at any time during the wedding. NLC Photography reserves the right to stop any photographic services paid for and leave the function should any other person take photographs with any professional equipment – with the deposit being forfeited.


GUEST COOPERATION:
The client is responsible for the conduct of their guests. THE CLIENT will direct all other service providers (florist, DJ, caterer, etc.) to provide any needed information and cooperation to the photographer. Coordination with other service providers is necessary to complete all the photography sessions as scheduled. THE CLIENT should share the photography schedule with other service providers to make sure that there is no conflict in times. In addition, events during the wedding day should be planned to make the best use of time for all vendors.

NLC Photography will not tolerate verbally or physically abusive behaviour, nor will it share its time or compete with guest photographers for the attention of the subjects. Unchecked guest conduct that interferes with photography may seriously affect the quality of the photographs taken and increase the number of times photos must be re-taken. If THE CLIENT is unable to control the conduct of their guests, resulting in an unacceptable degree of misconduct, or if the conduct of any of their guests damages the equipment of the photographer, it will result in the early or immediate departure of the photographer. The client understands that in such event, no refunds will be granted and the Client will be fully liable for all damage caused to equipment, including the cost of repair or (where repair is not reasonably possible) replacement.


LIMIT OF LIABILITY:
If the photographer is too ill or becomes injured and cannot supply the agreed wedding services, then liability is limited to a refund of any payments received and the photographer will make every effort to recommend a replacement photographer for you to book but this can not be guaranteed.
NLC Photography has working methods in place to prevent the loss or damage to your images. However, there is the unlikely possibility that images may be lost, stolen or destroyed for reasons beyond the photographer’s control. In these circumstances, liability is limited to the return of fees paid or part thereof according to the percentage of images supplied.

NON-GUARANTEE:
Although every possible care will be taken to produce photographs of all important and special events during the wedding, NLC Photograph cannot place an unconditional guarantee on the above. NLC Photography will not be held responsible for any ruined photographs due to guests’ (or any other) flashes; or any other ruined photographs due to any other cause in or outside of NLC Photography's control.
Although every effort will be made by NLC PHOTOGRAPHY to capture specifically requested photographs, failure to do so will not be the responsibility of NLC PHOTOGRAPHY if we are not provided sufficient time and or guest are found to be non-compliant, unhelpful and not present to undertake the requested photograph. It is required that all specifically requested group images are discussed prior to the wedding event and a shot list is provided.
It is also recommended that the B & G nominate a knowledgeable family member or guest to assist in grouping the required guests where necessary as no knowledge of many individuals will be known to NLC PHOTOGRAPHY.

SEVERABILITY & LIABILITY:
The named parties on this contract are both jointly and severally liable under this contract. Where this contract is signed electronically and signed by only one party they shall accept by signing this document that they have the authority and approval of the other party and agree it is done so on the absent parties agreement and are therefore both liable under the terms of this contract.
